The UK authority investigates Police Scotland's compliance with data access requests
The Information Commissioner's Office (ICO) has announced the opening of an investigation into Police Scotland's compliance regarding the processing of data access requests.
The investigation aims to determine whether Police Scotland failed to meet its legal obligations under articles 12 and 15 of the UK GDPR as well as article 45 of the Data Protection Act, notably by not responding to requests within the legal timeframes. The ICO specifies that this investigation is ongoing and that its opening does not prejudge its outcome. If breaches are identified, the authority may resort to corrective measures such as warnings, reprimands, or enforcement notices, or even impose fines up to £17,500,000 or 4% of the global annual turnover. Any contemplated sanction will be subject to a preliminary decision to allow the organization to respond.
