The Spanish authority publishes the second issue of the scientific journal on privacy, innovation, and technology

The Spanish Data Protection Authority (AEPD) has published the second issue of its scientific journal, "Privacy, Innovation and Technology," dedicated to the tenth anniversary of the GDPR and the challenges posed by technological evolution.

The special issue analyzes the application of GDPR principles in the face of complex technological scenarios. It addresses the evolution of the proactive accountability principle, which requires effective risk management systems and traceability of decisions, beyond mere formal documentation. The journal also examines the scope of the right to an explanation in automated individual decisions, in light of the case law of the Court of Justice of the European Union and in connection with the transparency obligations of the Artificial Intelligence Regulation. Finally, an article is devoted to the use of generative artificial intelligence by local public administrations, highlighting the importance of data protection by design as a preventive guarantee.

A "Privacy Studies" section complements this issue with nine research papers on various topics such as the protection of neurodata, the limits of automatic anonymization by artificial intelligence, comprehensive risk assessment related to security breaches, and the interaction between data protection and fundamental rights in smart cities. Also analyzed are the limits of transparency in algorithmic political advertising, civil liability arising from security breaches, legal risks of synthetic identity, and hybrid threats. The issue concludes with book reviews on international data transfers and non-discrimination in the face of algorithms.
