Schools must ensure the protection of students' data when using artificial intelligence

The Estonian data protection authority (Andmekaitse Inspektsioon, AKI) has reminded schools of their obligations regarding the use of artificial intelligence and the protection of students' data.

During an audio broadcast, a legal expert from the authority reiterated the points of a circular addressed to schools on artificial intelligence and digital solutions. It was emphasized that the responsibility for lawful data processing lies with the school, which must assess the impact on personal data protection before adopting new technologies. The discussion focused on measures to prevent the integration of students' personal and health data into artificial intelligence models, as well as the conditions for its use in teaching. Other topics addressed included informing parents and obtaining their consent, conducting data protection impact assessments, evaluating students' work via AI, and organizing the processing of data by the solutions used, including the location of servers.
