The presidential veto does not affect the powers of the president of the Polish authority regarding transparency and targeting of political advertising
The Polish Data Protection Authority (UODO) clarified that the presidential veto against a national law does not undermine its powers regarding transparency and targeting of political advertising.
The Polish President refused to sign the law of 4 September 2026, which aimed to ensure the application of Regulation (EU) 2024/900 on political advertising. However, the powers of the President of the UODO are not affected as they derive directly from this European regulation, applicable since 10 October 2025, the national law having only an organizational character in this regard. Under Article 22(1) of Regulation 2024/900, data protection authorities are responsible for monitoring compliance with the requirements of Articles 18 and 19 concerning techniques for targeting and dissemination of online political advertising. The European legislator has provided for the application of Article 58 and Chapter VII of the GDPR, and Article 25(6) of Regulation 2024/900 authorizes the UODO to impose administrative fines in accordance with Article 83 of the GDPR. It is noted that certain obligations of Regulation 2024/900 remain outside its competence. The European Data Protection Board (EDPB) is preparing guidelines on this subject, for which a public consultation took place on 27 March 2026.
