The Polish authority records an exceptionally low annulment rate of its decisions by administrative courts in 2025

The Polish Data Protection Authority (UODO) has reported a historically low annulment rate of its decisions by administrative courts in 2025.

In 2025, courts annulled only 39 of the 205 contested UODO decisions, establishing the success rate of appeals at 19.02%. This result is slightly lower than the previous record in 2023, which was 19.58% (37 annulments out of 189 appeals). The authority emphasizes that this performance was achieved while the number of decisions issued increased by 25% to exceed 2,000 over the year. The number of appeals filed against UODO acts amounted to 334 in 2025, a level close to the record of 335 reached in 2023. For comparison, annulment rates were 23.65% in 2024 and peaked at 37.5% in 2021. The authority attributes the sustained high number of appeals to increased public awareness since the pandemic.
