The Latvian authority changes its approach to handling complaints about video surveillance by individuals
The Latvian Data State Inspectorate (DVI) has announced a change in its procedure for handling complaints related to video surveillance implemented by natural persons.
From October 20, the authority will only open a thorough investigation if the complaint is accompanied by information and evidence supporting a potential violation. Complainants must also have attempted to clarify the situation beforehand with the person conducting the video surveillance. Without these elements, the Data State Inspectorate (DVI) will not initiate an investigation procedure but will provide a substantive response within one to three months, informing the data controller of their obligations if identifiable. Ongoing procedures will be completed according to the previous approach.
This new approach aims to focus resources on cases presenting a significant risk to individuals' rights, as many current complaints arise from neighborhood disputes unrelated to data processing. Evidence of violation may include the online publication of recordings or capturing images outside the controller's property, while the mere presence or orientation of a camera does not in itself constitute an infringement. Civil disputes, such as those related to property use, should be addressed to competent authorities such as the building manager or courts.
