The European Commission has launched a public consultation as part of the second evaluation of Directive 2016/680, known as the "Police Directive," and the Polish data protection authority encourages stakeholders to participate.
In accordance with Article 62 of Directive 2016/680, the European Commission periodically evaluates its implementation and practical operation in Member States. In this context, a public consultation is open until 14 September 2026 to collect feedback from relevant entities, including public authorities, justice and law enforcement professionals, as well as academics and specialized organizations. The objective is to gain an overview of the application of the directive and to verify whether it remains suitable for its purposes. The European Data Protection Board (EDPB) has already contributed to this evaluation by publishing a report based on feedback from national authorities, including that of Poland (UODO).

This evaluation is of particular importance for Poland, which is subject to an infringement procedure initiated by the European Commission. The procedure concerns an incorrect transposition of Directive 2016/680, specifically regarding provisions related to the exercise of the rights of data subjects. Poland has received a formal notice and has a two-month period to respond.
