The Dutch Data Protection Authority (AP) has issued a warning about the use of camera glasses, reminding that filming people in public spaces is generally prohibited under the GDPR.

Faced with the growing popularity of camera glasses, whose appearance increasingly resembles ordinary glasses, the AP emphasizes that capturing images of identifiable individuals constitutes processing of personal data. The exception for domestic use does not apply if the images are shared or published. The authority considers that valid consent is often impossible to obtain in public spaces and that the recording indicator light is insufficient to inform the data subjects. The AP advises organizations, especially in sensitive places such as hospitals or courts, to prohibit their use in internal regulations and is considering the possibility of stricter measures.

The AP also expresses concern about new models integrating artificial intelligence systems capable of analyzing the user's environment. This type of function may involve processing personal data, even without image recording, raising the issue of AI analyzing individuals without their knowledge. The authority reminds that responsibility also lies with manufacturers, who must integrate data protection by design, making recording clearly visible and limiting data collection to what is strictly necessary.
