The Dutch authority takes a new step in the supervision of artificial intelligence
The Dutch Data Protection Authority (AP) is strengthening its preparedness for the supervision of artificial intelligence (AI) with the creation of a new dedicated directorate.
The new Directorate for AI/Algorithm Surveillance and Coordination (TCA) will continue the coordinated monitoring activities of algorithms and AI conducted by the AP since 2023, while preparing for the future supervision of the AI market. In collaboration with the National Digital Infrastructure Inspectorate (RDI), the TCA will establish an "AI sandbox" and a joint AI Coordination Center. The AP, although envisaged as the market surveillance authority for AI, will only obtain its full powers after the entry into force of the Dutch implementing law of the AI regulation, with the deadline for the designation of supervisory authorities being August 2, 2025.
The TCA directorate is composed of two departments: one for Risk Analysis and AI/Algorithm Coordination (ARC), which focuses on societal impact and fundamental rights, and the other for AI Market Surveillance (MTA), which develops technical expertise to test AI systems. This initiative takes place in a context where certain rules of the European AI regulation are already applicable, such as transparency obligations for AI-generated content and the prohibition, from December 2, of systems that virtually undress people without their consent. The AP will rely on its experience gained under the GDPR for this new mission.
