The Use of Smart Glasses Raises Issues of Respect and Privacy
The Norwegian Data Protection Authority (Datatilsynet) has issued recommendations regarding the use of smart glasses by individuals, highlighting the privacy risks and the rules to be followed.
The authority reminds that the applicable rules are the same as those for mobile telephony. Although capturing images in public places for personal use is generally permitted, it is imperative to exercise discretion and respect the privacy of others. Filming should be avoided in situations where people expect confidentiality, such as places of worship, hospitals, or changing rooms. The dissemination of recordings is subject to stricter rules; for any public publication, the GDPR applies and the consent of identifiable individuals is generally required.
The authority also warns against covert audio recording of third-party conversations, which may be illegal, as well as the risks related to data exploitation by manufacturers. The latter may use recordings and associated location data for their own purposes, in accordance with often complex terms of use. It is therefore advised to be transparent about the use of the glasses and not to record information that one would not want to be disseminated, as the mere presence of the device can cause discomfort.
