Professional elections in the public service and electronic voting: how to submit expert reports to the CNIL?
The National Commission on Informatics and Liberty (CNIL) specifies the procedures for submitting independent expert reports, now mandatory for public service bodies using electronic voting for their professional elections.
Since 2024, bodies from the three public services (state, territorial, and hospital) organizing professional elections by electronic voting must mandatorily submit to the CNIL the independent expert reports of their system. This submission is done by email to a dedicated address, with a specific procedure for files larger than 7 MB via a secure transfer platform. The documents to be communicated include the expert's initial report on the voting solution and procedures, the final post-election report detailing electoral and archiving operations, as well as any additional report possibly requested by the organizer. This same address can be used to ask questions or for voluntary submissions by entities not subject to this obligation.
