The President of the Polish Authority Emphasizes the Need to Expand the Expedited Removal Procedure for Illegal Content and Strengthen Protection Against Deepfakes

The Polish data protection authority (UODO) maintains its requirements regarding the Polish bill aimed at implementing the Digital Services Act (DSA), despite taking into account some of its initial remarks.

The bill, submitted on June 17, 2026, to the Committee on Digital Affairs, Innovation and Modern Technologies, aims to establish a procedure for blocking unlawful content. Although the Ministry of Digital Affairs has included clarifications on the processing of data of involved persons and on the anonymization of decisions published by competent authorities, the President of the UODO has sent new observations to the parliamentary committee. The authority insists on three main points: expanding the catalog of offenses qualifying content as illegal to include the processing of child pornography content (Article 202, paragraphs 3-4c of the Penal Code) and unlawful data processing (Article 107 of the Data Protection Act and Article 54 of the Act on Data Processed in the Context of Crime Fighting); introducing an immediate execution clause for removal decisions in the most serious cases, notably to protect minors against sexual exploitation and deepfakes; and ensuring the consistency of the bill with other texts related to new technologies to combat privacy violations.
