NOYB: The European Commission abandons the project to remove cookie banners due to opposition from Google and some Member States

The Council of the European Union has abandoned the European Commission's proposal to replace cookie banners with an automated consent signal.

The Commission had initially proposed to introduce a new Article 88 ter to the GDPR to substitute cookie banners with an automated mechanism to communicate consent preferences. This initiative aimed to counter the use of "dark patterns" that lead to high consent rates for online tracking, often against the real will of users. However, faced with opposition from certain tracking sector actors and Member States, including Germany and France, the Council has completely withdrawn this measure from its proposal dated June 18. The European Parliament has not yet finalized its position, and the future of this simplification will depend on the final compromise between the two institutions.
