The Dutch Data Protection Authority (AP) offers informal and confidential discussions to organizations to address the upcoming AI Regulation.

As the future designated supervisory authority, the AP aims through this initiative to help entities understand the application of the text in their specific context, while gathering practical feedback to develop guidelines and best practices. These exchanges, which do not constitute a formal assessment nor a legally binding opinion, may cover the scope of the regulation, the obligations of providers and deployers, high-risk AI systems, or transparency requirements. The authority specifies that these discussions concern only the AI Regulation, with issues related to the GDPR or other privacy laws being handled by another service. It is also working on setting up a regulatory sandbox for more specialized questions.

The Dutch cabinet published, on April 20, 2026, a draft law implementing the AI Regulation, providing for shared supervision among several existing authorities. Within this framework, it is proposed that the AP become the supervisory authority for areas not yet covered, notably AI applications prohibited by Article 5, high-risk AI systems listed in Annex III, and transparency obligations. The AP and the National Digital Infrastructure Inspectorate (RDI) would also be assigned a coordination role within this supervisory framework.
