The Conference of German Freedom of Information Delegates addressed, during its meeting on June 10, 2026 in Potsdam, issues related to transparency, the balance between freedom rights and public security, as well as the use of artificial intelligence for the anonymization of judicial decisions.
The delegates examined a project from Friedrich-Alexander University Erlangen-Nuremberg aimed at the automated anonymization of judicial decisions by artificial intelligence, seeing it as an opportunity to expand public access while reducing the courts' workload. The debates also focused on reconciling freedom rights and the protection of public security, with the Brandenburg delegate for data protection and access to documents emphasizing that "freedom rights must be conceived as a positive value to be defended." In view of the seven regional elections scheduled by May 2027, the delegates encouraged citizens to use the right of access to information to inform themselves from objective sources.

The conference also analyzed a judgment from the Berlin Administrative Court dated March 20, 2026 (ref. 2 K 3/24), which qualifies SMS messages retained by the Federal Foreign Office as official information within the meaning of the Freedom of Information Act. This decision supports the position of the delegates, who had already stated that relevant official communications made via instant messaging services, social networks, or SMS, especially by government members, constitute official information that must be included in files to guarantee the right of access, which must be ensured by internal regulations.
